1. Introduction
These Terms of Service (“Terms”) govern your use of the Strong Finish Inc. website (https://www.strongfinishinc.com) and the website design, development, hosting, and support services we provide (“Services”).
By accessing our website or engaging our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or Services.
Strong Finish Inc. is based in St. James, Barbados. These Terms apply to all clients, whether local or international.
2. Services Provided
Strong Finish Inc. provides the following Services:
- Website design and development — creation of professional, mobile-friendly websites based on the package and scope agreed with the client.
- Monthly hosting and support — ongoing hosting, basic maintenance, security updates, minor content updates, and support as described in our Subscription Terms.
The specific scope, timeline, and deliverables for each project will be agreed upon between Strong Finish Inc. and the client before work begins.
3. Client Responsibilities
To enable us to deliver the Services effectively and on time, clients agree to:
- Provide accurate and complete information about their business, website needs, and preferences.
- Provide content (text, images, logos, and other materials) in a timely manner and in a usable format, unless content creation has been separately agreed.
- Review designs, drafts, and deliverables promptly and provide clear feedback and approvals within agreed timeframes.
- Ensure they have the rights or licences for any content, images, logos, or materials they provide for use on their website.
- Maintain the confidentiality of any login credentials or access details provided to them.
- Use the website and any associated services in a lawful manner and not for any illegal, harmful, or abusive purpose.
4. Payment Terms
Payment terms for our Services are as follows:
- Setup fee — the one-time setup fee for the website design and development (typically USD $350 for our standard 3-page package) is due as agreed in the project proposal or invoice, typically before or at the start of the build process.
- Monthly subscription — the recurring monthly fee (typically USD $75 per month) is due on a recurring basis as agreed. Payment is required to keep hosting, maintenance, and support active.
- Additional services — any work outside the agreed scope (such as additional pages, custom features, extra revisions, or content creation) will be quoted separately and invoiced accordingly.
All fees are stated in US Dollars (USD) unless otherwise agreed in writing. Payment methods and schedules will be communicated at the time of engagement.
5. Late Payment and Suspension
If a monthly subscription payment is not received by its due date, Strong Finish Inc. reserves the right to suspend the website and associated services until payment is received. This means the client’s website may become temporarily inaccessible.
We will make reasonable efforts to notify the client of any overdue payment and allow a reasonable grace period before suspending services. Repeated late payments or non-payment may result in termination of the service relationship in accordance with our Cancellation Policy.
6. Content Ownership
Clients retain ownership of their business name, branding, logos, and any content they provide to Strong Finish Inc. for use on their website.
Upon full payment of all applicable fees, clients receive a licence to use the website design and structure created by Strong Finish Inc. for their business. The underlying code, frameworks, and design systems used to build the website remain the intellectual property of Strong Finish Inc. and/or the platforms and tools used to build it.
If a client wishes to transfer their website to another provider, Strong Finish Inc. will cooperate reasonably to facilitate the transition, subject to any outstanding payments being settled. See our Cancellation Policy for more details.
7. Third-Party Services
Our Services may involve the use of third-party platforms, tools, or services (such as hosting providers, domain registrars, payment processors, scheduling platforms, analytics tools, or other integrations).
Strong Finish Inc. is not responsible for the availability, performance, or practices of third-party services. Where a third-party service is essential to a client’s website, any issues with that service will be communicated to the client, and we will work to find a reasonable solution.
8. Acceptable Use
Clients agree not to use their website or our Services for any unlawful, harmful, fraudulent, or abusive purpose. This includes, but is not limited to:
- Hosting or distributing illegal content
- Engaging in spam, phishing, or malicious activity
- Infringing on the intellectual property rights of others
- Distributing malware, viruses, or harmful code
- Using the website in a way that disrupts or degrades service for others
- Any activity that violates applicable laws or regulations
Strong Finish Inc. reserves the right to suspend or terminate Services for any client found to be in violation of these acceptable use provisions.
9. Limitations of Liability
Strong Finish Inc. provides its Services in good faith and with reasonable skill and care. However, to the fullest extent permitted by applicable law:
- Strong Finish Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use our website or Services.
- Strong Finish Inc.’s total liability for any claim arising from or relating to these Terms or our Services shall not exceed the total fees paid by the client to Strong Finish Inc. during the twelve (12) months preceding the event giving rise to the claim.
- Strong Finish Inc. does not guarantee uninterrupted or error-free operation of websites, as factors such as third-party hosting, domain services, internet infrastructure, and client actions can affect availability.
10. No Guarantee of Search Engine Ranking
While we include basic SEO setup (such as proper page titles, meta descriptions, heading structure, and mobile optimisation) as part of our Services, we do not guarantee any specific search engine ranking, position, or traffic level. Search engine algorithms, competition, and other factors are outside of our control.
Clients should be cautious of any service provider that promises first-page rankings or specific traffic numbers, as such guarantees are generally not possible to make in good faith.
11. No Guarantee of Business Results
Strong Finish Inc. builds professional websites designed to present your business clearly and make it easy for customers to contact you. We do not guarantee that a website will result in any specific level of sales, enquiries, leads, revenue, or business growth. A website is one part of a broader business and marketing effort, and results depend on many factors beyond the website itself.
12. Intellectual Property
All content on the Strong Finish Inc. website, including text, graphics, logos, design elements, and code, is the property of Strong Finish Inc. and is protected by applicable copyright and intellectual property laws, unless otherwise stated.
Clients retain ownership of materials they provide. Strong Finish Inc. retains ownership of its design work, code, and methodology, subject to the licence granted to the client as described in Section 6 (Content Ownership).
13. Termination
Either party may terminate the service relationship by providing notice in accordance with our Cancellation Policy.
Strong Finish Inc. reserves the right to terminate Services immediately if a client breaches these Terms in a material way, including but not limited to non-payment after reasonable notice, violation of acceptable use provisions, or engagement in illegal or harmful activity through the website.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Barbados, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of Barbados.
For international clients, local consumer protection laws in your jurisdiction may also apply to the extent they cannot be excluded by agreement.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify existing clients and update this page. Continued use of our Services after changes take effect constitutes acceptance of the updated Terms.
For ongoing client relationships, the Terms in effect at the start of the engagement continue to apply to that engagement unless otherwise agreed in writing.
